Terms and Conditions of Website use.
The following rules and regulations apply to all visitors and customers of this website; barhajewellery.com. By using the website, the customer will be bound by all of the subsequent terms and conditions, creating a legally binding agreement between the customer and Barha CK 2017/318515/07. These terms and conditions replace any previous agreement and understanding in relation to the subject matter hereof. If there is a violation of these terms and conditions Barha Jewellery reserves the right to seek legal action. The Barha Jewellery website and all its contents (all text, photographs, images, video, and audio) are exclusively property of Barha Jewellery. All the designs, logos and the use of the name Barha is sole property of Barha CK 2017/318515/07. Website visitors and customers are not permitted to publish, distribute, manipulate or otherwise reproduce, in any format, any of the content or copies of the content supplied to visitors and customers or which appears on the website nor may visitors and customers use any such content in connection with any business or commercial enterprise.
The registered address of Barha Jewellery is suite 109 Business Partners, 23 Jan Hofmeyer Road, Westville, Durban, KwaZulu-Natal, 3630. Barha Jewellery is our trading name. For the purpose of these terms and conditions of the website Barha Jewellery refers to barhajewellery.com. These terms and conditions govern the customer’s use of barhajewellery.com and purchase of goods from the site. By continuing to access the Barha Jewellery website the customers accept and consent to these terms and conditions, which may be updated at any time, we, therefore, recommend a regular visit to this page. Continued use of the site signifies the customer’s agreement to any modified terms and conditions.
In the following terms and conditions reference to “us” and “we” is a reference to barhajewellery.com. Reference to “you” is a reference to the visitors and customers/purchasers of the goods sold on barhajewellery.com. The terms Item/s or piece/s is in reference to the goods sold on barhajewellery.com.
Privacy Policy.
When you purchase from Barha Jewellery you will be required to provide us with your personal information. We keep this information in the strictest confidence and will not disclose it with any third party without your consent, except for the purposes of processing your order and arranging delivery.
We do not store our customer’s financial details.
If you purchase from our website you will be provided with the option to be added to our newsletter, which will keep you informed about new products and collections, events, news and sales. You can also unsubscribe from our newsletter at any time.
Terms of Sale.
By placing an order on barhajewellery.com you are offering to purchase a product subject to these terms and conditions below. All orders are subject to availability and confirmation of the order price. We must receive the payment in whole. Once we have received the payment, we will confirm that your order has been received by sending an email to you at the email address you provide in your account. This means we have accepted your order and we will process and dispatch your purchase to you unless we notify you that we do not accept your order, or you have cancelled your order (before dispatch).
Ordering Online.
When you place an order with us, you can rest assured that all of your data is safe and secure and that we do not store any of your financial details. All of our payment processing partners are certified.
It is up to you (the customer) to ensure that all of the information which you are required to provide when placing an order is accurate and complete in all respects at the time of order and that this information relates to you/the person placing the order and not to any third party.
When an order is made on our website, the order confirmation issued by the company clearing the credit/debit card payment does not constitute acceptance of your order. Only an email confirmation of your order from Barha Jewellery constitutes acceptance of your order. We reserve the right to check any discrepancies first, before the order is confirmed by us.
Any error in any ordering process due to technical or other reasons beyond our control entitles us not to treat the order as being binding on us.
Prices.
The prices payable for each item/s are shown on the product pages and are correct on the date the customer places the order. All prices include VAT (Value Added Tax) and are in South African Rands. Any prices shown on printed material (except for errors/emissions) are correct at time of printing but are subject to change without any prior notice.
The price of packaging is included in the price of each item. However, the cost of shipping is shown separately at the checkout and will be quoted based on your location (national main city = R80.00, or national rural area = R120.00) and is payable in full, separate from the price of the item/s.
Sales Items.
Please note that the purchase of sales items is final and cannot be returned/ exchanged unless there is a manufacturing fault.
Operating Hours, Off-Season and Breaks.
Please note that Barha Jewellery is a small artisan jewellery company and therefore operates from Monday to Friday between 8am to 5pm. During these hours’ orders will be processed, dispatched and delivered, and customer emails will be answered. We do not operate outside of these operating hours or on Saturday and Sunday.
Barha Jewellery will be closed on public holidays, therefore orders placed on these days will be processed on the following working day.
If there are other instances when Barha Jewellery will have close its orders, customers will be notified in advance via newsletter and social media.
Coupon Codes.
Barha Jewellery may offer coupon codes, which can be used at checkout on your purchase. These coupon codes can only be used on FULL PRICED ITEMS and cannot be used in conjunction with any other offer or discounts.
When an order is placed using a coupon code and the order contains a number of items, the value of the discount is spread over each item.
Any refund of an item that was purchased using a coupon code will be reduced by the value of the discount attached to it. The discount will not be refunded.
Under no circumstances can the value of the coupon code be deducted from an order if the code is defective or out of date. No replacement codes will be issued in this case.
These codes cannot be used to discount delivery costs.
We retain the right to cancel a discount or promotion at any time.
Only one coupon code can be used at any given time unless otherwise stated.
Payment Options.
We accept credit card payments (Visa and Mastercard) and Instant EFT Payments.
Payments on our website are safe and secure as we use Peach Payments who have PCI DSS Level 1 compliance.

All payments must be made in full before your purchase is confirmed, processed, dispatched and delivered.
Deliveries.
All orders are shipped from our head office in Durban. Shipping will take between 2 to 7 working days.
Item/s will be shipped to the address provided at time of order, so please ensure you have provided the correct address. We only offer expedited shipping with real time tracking.
Shipping to your location can be calculated at checkout and is calculated according to your location. If you live in a national main city in South Africa you will be charged R80.00, if you live in a national rural area in South Africa you will be charged R120.00. Shipping is free to all order over R650 for both national main cities and national rural areas. You can email us at info@barhajewellery.com if you have any concerns.
If your order is returned to us because the courier service could not complete the shipping to you for whatever reason, then you will be responsible for the repeat delivery cost.
If your order has been damaged during transit, you must notify us within 48 hours. In such a circumstance you must keep the order as is as this may be required to make a claim.”
LOST ORDERS.
If you have not received your order within 7 working days, please contact us at info@barhajewellery.com and we will contact the courier service and update you on your order whereabouts. However, if the order has been lost, we will inform you via email and give you the option to request a refund (excluding the delivery cost), or to request a replacement of all the items you ordered.
We cannot be held responsible for any delays once your order has left us.
Returns.
- The item/s has been damaged in transit (contact us within 48 hours)
- The item/s is defected i.e. it has a manufacturing fault
- The item/s is incorrect (not what the customer ordered)
- The item/s is the wrong quantity
Please note that wear and tear due to the occasional use of jewellery is not a defect or manufacturing fault.
However, we (Barha Jewellery) do not accept returns on items for the following reasons;
- The item/s is a sales item
- The item/s is a custom order (personalised)
- The item/s is a special order (customer has requested changes in size, colour or stones and beads used in the piece of jewellery)
- Parts of the item/s has broken. Barha Jewellery is delicate and must be handled with care in order to preserve the lifespan of the jewellery. For instance, the semi-precious stones and glass beads used in the jewellery can break (from dropping or bumping the piece against a hard surface) if the piece is not handled with the utmost care. Items/ pieces will not be processed for returns if parts of it have broken due to negligent use or carelessness.
- Parts of the item/s have become worn out. For instance, all the threads used in the jewellery needs to be handled with care, as they will fray or become worn out if they come into contact with water or any form of moisture. Items/pieces will not be processed for returns if the silk thread tassels or macramé pieces have frayed or are worn out due to negligent use or carelessness.
- Items/pieces will not be processed for returns if tarnishing of the plating occurs, as this is due to general wear and tear and exposure to moisture, perfumes and heat from the body over a certain period of time.

How to Process a Return.
To request a return the you (the customer) must email Barha Jewellery at info@barhajewellery.com within the 7 day period of receiving your purchase, as long it is unused and is in the original condition and packaging. Item/s returned outside of the above time frame will not be accepted and will be returned to the customer. Any items returned without prior notice in writing will not be accepted.
The email must state the following;
- Reason for the return request
- State the name and SKU of the item/s you wish to return
- Photos of the item/s to prove that it is damaged, has a manufacturing fault, is incorrect or is of the wrong quantity.
- Proof of purchase in the form of an email confirmation from Barha Jewellery or your order number.
- State if you would like the item exchanged (for the exact same item) or you would prefer a full refund (Please note that refunds includes price of item/s and excludes cost of delivery as delivery is non-refundable).
Items should be returned new, unused, and correctly packaged to avoid damage during transit. Returns that are damaged or soiled will not be accepted and may be sent back to the customer.
We reserve the right to arrange collection, in which case you will be responsible for collection charges.
Barha Jewellery will not be held responsible for item/s that may be lost or damaged during return shipping so please ensure all items being returned are securely packaged. Any items that are not thoroughly packaged (to avoid damage during transit) will not be accepted by the shipping company, so please take care when posting.
Once we (Barha Jewellery) have received the item/s for return, we will assess the jewellery and then send you (the customer) the replacement (of the same item, in the same colour) or process your refund. Please note that Barha Jewellery reserves the right accept or deny an exchange or refund if the item/s does not meet our returns policy requirements and it is deemed that care instructions were not followed.
Depending on who you bank with, a refund may take some time to reflect in your account (up to 30 days). If a significant amount of time has passed and you still cannot see the money in your account, contact your bank first to check if the refund is still processing, if that is not the problem then please email us at info@barhajewellery.com
Warranties and Liability.
Upon delivery the loss or damage to item/s passes to you (the customer).
Ownership of all item/s remains with us until full payment of all amounts due to us have been received from you.
Barha Jewellery is not for children under the age of 11, due to small pieces which may cause a choking hazard and gold plating which may be unsafe for young sensitive skin.
We guarantee that the item/s you order will meet the description as shown on our website (or any other description given to you in writing).
Barha Jewellery will not be held liable or responsible for any harm or accidental damage caused to people or property by its jewellery pieces and/or components.
We trust our supplier information to be accurate and act in good faith. We do not carry out any gemological, chemical or other tests on materials provided by our suppliers
We do not accept responsibility for any wear and tear, accidental damage (after delivery) or failure by you or by any third party to adhere to any written recommendation provided in relation to the item/s.
Product Variation from Image on Website.
Please note that due to the handmade nature of Barha Jewellery and the use of natural semi-precious stones and glass beads in our pieces, the colours, cut, shape and patterns in the stones and beads may vary from piece to piece.
A lot of care has been taken to photograph the jewellery to represent the colours of each piece as accurately as possible, however please account for variations in colour of the jewellery, as their appearance may be different in reality, depending on the type of screen or monitor you view the images on.
Please note that the size of each piece is indicated on each item page, and that the images are zoomed in and therefore do not represent the actual size of each piece.
Product sizes.
It is up to the customer to ensure that the size of the jewellery is correct for them before making their purchase, as Barha Jewellery does not accept returns on jewellery that in the wrong size. Each piece of jewellery has wrist sizes in centimetres on each product page.
Care Instructions.
Barha Jewellery items are delicate, particularly items with threads, natural semi-precious stones and glass beads, so please handle item/s carefully. If dropped stones and beads may break, and if threads contact moisture they will fray and wear out.
Items must not come in contact with cosmetics, perfumes, hairspray and prolonged exposure to sunlight as this may cause tarnishing and discolouration.
Items must not come into contact with water, moisture or any liquid as this will cause tarnishing and discolouration. Remove all jewellery before showering or conducting household chores such as cleaning.
Metal components of each item can be cleaned with a soft jewellery polishing cloth.
We strongly advise you to store jewellery in a clean, dry environment, preferably in separate compartments of a jewellery box, or in separate plastic bags.
Packaging.
All items are placed on jewellery boards, and placed in transparent plastic packets, wrapped in tissue paper and placed in a padded brown envelope to be delivered to you.
